The New Mexico Oil and Gas Act, Article 1, § 2, New Mexico Constitution, is amended by adding subsection (d) (in its entirety): (d) All agencies that have jurisdiction over wells and the mineral and geothermal properties within those wells shall provide and post oil recovery and control records for all wells in their respective jurisdiction, including record copies on electronic media in electronic format. (e) All agencies that have jurisdiction over wells and the mineral and geothermal properties within those wells shall provide and post oil recovery and control records, as required by this section, with each report filed with them. At the time of filing, in addition to any other filing procedures that the agency shall have prescribed, the individual on whose behalf such reports are filed shall supply to the agency copies of the record containing the information concerning that well. The agency shall provide such information and copies to the individual on whose behalf the reports are filed. Nothing in this subsection or section shall be construed to require the reporting agency to include information related to the location of the well, with respect to the individual on whose behalf the related report was filed. (f) The Oil and Gas Act shall not apply to a well that has reached the end of its permissible life or is subject to a moratorium pursuant to the State Environmental Policy Act.
